
National Youth Service(NYS) suspect has been sentenced to 5 years in jail for forging IEBC tender documents in 2013 general elections.
Gethi was convicted alongside his co-director Joyce Makena as well as former Independent Electoral and Boundaries Commission (IEBC) officers Kennedy Ochae, Willie Gachanja and Gabriel Mutunga.
The prosecution proved they committed the offences, however Chief Magistrate Lawrence Mugambi granted Gethi an alternative fine of Sh4 million.
“The five accused persons, on diverse dates between October 22, 2012 and November 23, 2012 at IEBC offices, anniversary towers colluded to change the price scheduled submitted by solarmark Technologies for the supply of solar lanterns for the March 2013 general elections to facilitate the award of the said tender to Solarmark Technologies Limited company co-owned by Benson Gethi and Joyce Makena,” Director of Public Prosecution Noordin Haji said in a statement.
Magistrate Mugambi further noted that Gethi and Makena will bear the greater burden because they were the once who were supposed to benefit from the forgery.
Gethi and Makena were ordered to pay sh1.5 million or serve a two years jail. They were also ordered to pay Sh500, 000 each for being directors of Solarmark
The IEBC officials were each separately sentenced for the two counts they were convicted in.
The court said Mutunga was sentenced to serve two years in prison or pay Sh2.8 million fine while Ochae was ordered to pay Sh200,000 fine or serve one year in jail.
The court proved that they have found them guilty and beyond reasonable doubt that they committed the offence and they should comply with the law.
